e) You are aware of the risks of using BitDa's services. Such risks include the high volatility of Bitcoin and Ethereum, and you may lose all Bitcoin or Ethereum in your trading account if adverse market changes occur;
f) You will not engage in or initiate any form of market manipulation, including false orders or other activities;
g) The information or documents you provide are accurate, true, and up-to-date;
h) The Bitcoin or Ethereum withdrawal addresses you provide are your own addresses, and you have full control over them.
i) If you reside in China, Hong Kong, the USA, or Canada, you also understand and confirm that you may not hold positions on BitDa, nor enter into contracts on BitDa. You understand and confirm that if we discover any BitDa trading participant making false representations regarding their location or residence, BitDa has the right to immediately close their accounts and liquidate any open trades.

4.Indemnity
4.1 You agree to indemnify and hold harmless BitDa, its contractors, licensors, and their respective directors, officers, employees, and agents from any and all claims and expenses (including legal fees) arising from your use of the website (including but not limited to your breach of this Agreement) and ensure that they are protected. 4.2 Under no circumstances will BitDa or its suppliers or licensors be liable for any of the following under any contract, negligence, strict liability, or other legal theory:
a) Any special, incidental, or consequential damages;
b) Costs of acquiring or replacing products or services;
c) Interruptions in use, loss, or corruption of data;
or d) Any amount exceeding the fees you paid to BitDa under this Agreement in the twelve (12) months preceding the event giving rise to the claim. BitDa shall not be liable for any non-performance or delay in performance caused by matters beyond reasonable control. The above provisions do not apply to the extent prohibited by applicable law.
5.Calculation
All calculations executed by the BitDa trading engine and verified by BitDa shall be final.
6.Limitation of Liability
6.1 To the maximum extent permitted by applicable law, BitDa, our directors, employees, agents, suppliers, distributors, service providers, or other users shall not be liable for any direct, special, indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to damages for loss of use, loss of profits, loss of information, business interruption, damage to revenue or goodwill (whether based on contract, tort (including but not limited to negligence)), or for any other damages arising from the use or inability to use the website or any errors, omissions, interruptions, deletions, defects, viruses, delays in operation or transmission, or website functionality failures, or for any information transmitted to BitDa.
6.2 To the maximum extent permitted by applicable law, BitDa, our directors, employees, agents, suppliers, distributors, service providers, or other users shall not be liable for any amounts exceeding the fees you paid to BitDa for the six (6) months preceding the event giving rise to the claim, regardless of whether the claim is based on contract, warranty, tort (including but not limited to negligence), product liability, strict liability, or any other cause arising from the use or inability to use the website or any errors, omissions, interruptions, deletions, defects, viruses, delays in operation or transmission, or website functionality failures.

8.Termination of Agreement

9.1.4 Transaction Information: For all corporate and individual accounts, we collect transaction information including (but not limited to) deposit snapshots, account balances, transaction records, withdrawals, order activities, and distribution records. We carefully enforce agreements with third parties and investigate any violations of our terms of use. BitDa reserves the right to provide services to users involved in violating the terms of use.
How We Protect User Data: BitDa has implemented several security measures to ensure that user information is not lost, misused, or altered.
Our data security measures include but are not limited to: PCI scanning, Secure Sockets Layer (SSL) encryption technology, anonymization, internal data access restrictions, and strict office and file access limitations. However, electronic storage on the internet cannot guarantee 100% information security. If you suspect that personal information, especially account or password information, has been compromised, please immediately freeze your account and contact BitDa customer service.
10.No Waiver
